Terms of Service

1. Acceptance of Terms
These Terms of Service (the "Terms") govern your access to and use of SwiftyQuill, a voice-first note-taking and AI workspace available at https://swiftyquill.com(the "Service"), operated by SwiftyQuill ("we", "us", or "our"). By creating an account, browsing the public site, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service (or the age of digital consent in your country, if higher). By using the Service you confirm that you meet this requirement, that all information you provide is accurate, and that you are not located in a jurisdiction where the Service is subject to an applicable export or other legal restriction.
3. Accounts & Security
- You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
- You must provide a valid email address and keep your account information up to date.
- Notify us immediately at support@swiftyquill.com if you suspect unauthorized access.
- We may suspend, disable, or delete accounts that violate these Terms, with or without notice.
4. Your Content
You retain all ownership rights in the notes, voice recordings, transcripts, images, and other content (collectively, "Your Content") you create or upload through the Service.
You grant SwiftyQuill a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of operating and improving the Service for you — for example, storing your notes, transcribing your recordings, sharing notes you explicitly choose to share, and running the AI features you request. We do not use Your Content for advertising and we do not sell it.
You are solely responsible for Your Content. You confirm you have all rights needed to upload it, and that it does not infringe the rights of others or violate applicable law.
5. AI-Powered Features
- Our AI features (transcription, summaries, action items, key insights, and the personal agent) generate output based on the content you provide. AI output may be inaccurate, incomplete, or unsuitable for your purposes.
- You are responsible for reviewing and verifying AI-generated output before acting on it, especially for important or sensitive decisions.
- Content you process through AI features is sent to our third-party AI provider as described in our Privacy Policy.
- AI features may be subject to their own usage limits depending on your plan.
6. Connected Services & Third-Party Services
The Service may let you connect third-party services (such as Google, WhatsApp, or external MCP clients) or rely on third-party providers (hosting, email, payments, AI). Those services are governed by their own terms and privacy policies, and we are not responsible for them. When you connect a service, you authorize SwiftyQuill to access it only as you direct, and you may revoke access at any time. Some features may require third-party service providers to have their own keys and credentials configured.
7. Plans, Subscriptions & Payments
The Service offers a free plan and paid plans (currently a Pro subscription). Free plans are subject to limits (for example, on the number of notes, transcription minutes, or storage). Paid plans renew automatically until cancelled.
- All prices are as displayed at the time of purchase and may change with notice for future renewals.
- Payments are processed by third-party payment providers; we do not store your full payment card details.
- You can cancel auto-renewal at any time; access continues until the end of the paid period.
- Refunds are available where required by law; for consumer accounts generally, we evaluate refund requests on a case-by-case basis.
8. Affiliate Program
SwiftyQuill may offer an affiliate/referral program. Referral commissions and payouts are governed by the program rules displayed in the Service. Commissions apply only to qualifying paid conversions, may be adjusted to correct errors or fraud, and payouts may be withheld if the associated account is terminated for abuse.
9. Prohibited Conduct
- Violate any applicable law, regulation, or these Terms.
- Upload content that is unlawful, defamatory, harassing, hateful, or infringing, or that glorifies violence.
- Transcribe or store recordings made without the consent required in your jurisdiction.
- Attempt to access another user's account, notes, or data.
- Probe, scan, or test the security of the Service or its infrastructure without authorization.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Resell, sublicense, or provide the Service to others on a commercial basis without our permission.
- Interfere with the Service (including via excessive automated requests, scraping, or denial-of-service attacks).
- Use the Service to send spam or unauthorized communications.
10. Moderation, Reports & Termination
We may review content for compliance with these Terms and investigate reports submitted within the Service. We may remove content, suspend accounts, or terminate access — with or without notice — if we reasonably believe you have violated these Terms, harmed other users, or created legal risk. You may delete your account at any time; deletion removes your content as described in our Privacy Policy.
11. Intellectual Property
The Service, including its software, design, trademarks, logos, and content (other than Your Content), is owned by SwiftyQuill or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service except as permitted by law.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that AI output will be accurate.
13. Limitation of Liability
To the maximum extent permitted by law, SwiftyQuill and its providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or profits, arising from your use of the Service. Our total aggregate liability for all claims relating to the Service shall not exceed the greater of the amounts you paid us in the six (6) months before the claim, or one hundred dollars (US $100). This section does not limit liability that cannot be excluded or limited under applicable law.
14. Indemnification
You agree to indemnify and hold harmless SwiftyQuill, its affiliates, and their respective personnel from any claims, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, Your Content, or your violation of these Terms.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the effective date below and, where appropriate, notifying you within the Service. Continued use of the Service after changes take effect means you accept the updated Terms.
16. Governing Law
These Terms are governed by the laws applicable in your place of residence, without regard to conflict-of-law principles. Where you have statutory consumer protections, they are not limited by these Terms.
